This document establishes the terms and conditions governing the commercial relationship between Olé Gourmet Market LLC  and the users or customers who make purchases through our website.

1. Scope of Application and Jurisdiction

Ole Goumert Market LLC is a legal entity incorporated in the State of Florida, United States. By making a purchase on this site, the Customer agrees that any legal dispute will be governed by the laws of the State of Florida and shall be submitted exclusively to the jurisdiction of the courts of Miami-Dade County..

2. Products and Visual Representation

  • Authenticity: The Company guarantees that all marketed products are authentic and of Spanish origin, complying with FDA (Food and Drug Administration) and USDA regulations for distribution in the USA.
  • Artisanal Variations: Due to the artisanal nature of our cheeses, charcuterie, and sweets, the Customer acknowledges that weight, shape, and color may vary slightly from the images shown, which are for illustrative purposes only.

3. Pricing and Tax Policy

  • All prices are expressed in U.S. Dollars (USD).
  • Sales Tax: In accordance with Florida State law, the corresponding sales tax will be applied to all orders shipped within the state. For orders outside of Florida, the Customer is responsible for any use tax their state may require.

4. Shipping and Perishable Goods Management

  • Cold Chain: Products requiring refrigeration (charcuterie and cheeses) are shipped with thermal insulation materials and gel refrigerant packs.
  • Delivery Responsibility: It is the Customer's responsibility to be present to receive the package on the first delivery attempt. The Company is not responsible for product degradation if the package remains outdoors or in adverse weather conditions after delivery is confirmed by the carrier (UPS/FedEx/USPS).).
  • Weather Restrictions: During periods of extreme heat, the Company reserves the right to delay shipments or require expedited shipping methods (Overnight o or 2-Day) to guarantee product integrity.

5. Return and Refund Policy

Given the food-based and perishable nature of our products, and for strict safety and hygiene reasons:

  • Final Sale: All sales of food products are final. No returns are accepted.
  • Incidents: If a product arrives damaged or in unfit condition, the Customer must notify olegourmetmarket@gmail.com within 24 hours of receipt, including photographic evidence of both the packaging and the product. The Company will evaluate the case to proceed with a replacement or store credit, as applicable.

6. Food Safety and Allergens

The Customer assumes responsibility for reviewing product labels and descriptions before consumption. Our products may contain allergens such as nuts, dairy, gluten, and others. Once the product is delivered, the responsibility for its proper preservation (adequate refrigeration) rests exclusively with the Customer.

7. Limitation of Liability

To the maximum extent permitted by law, Olé Gourmet Market LLC shall not be liable for indirect, incidental, or consequential damages resulting from the consumption or misuse of the products purchased, beyond the refund of the purchase value of the affected product.

8. Amendments

The Company reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website following such changes constitutes acceptance of the new Terms.
